US judge refuses to dismiss Google trademark suit


SAN FRANCISCO: A US judge refused on Wednesday to dismiss a lawsuit against Google Inc that charges the Web search leader's AdWords program abuses trademarks. In making his decision to allow the case to move forward US District Court Judge Jeremy Fogel ruled the public has an interest in whether AdWords the company's popular pay-per-click advertising system violates US trademark law.

On Tuesday Google took another step closer to offering a complete alternative to Microsoft's ubiquitous Office suite of desktop productivity applications. Eric Schmidt Google's chairman and chief executive announced that the search giant would add presentation software dubbed Presently to its emerging lineup of online office software. 'Collaboration is a killer app for how communities work ' Schmidt said in his keynote presentation at the Web 2.0 Expo in San Francisco. His presentation was made using Presently the new software designed to enable presentations to be made and shared over the Web. The software essentially fills out Google's online package of Microsoft Office-like applications. The package of apps called Docs & Spreadsheet is free and can be accessed from any computer with an Internet connection. The apps enable users to save files locally to their computers or upload them to the Web and work collaboratively with other users. No Release Date No formal release date for Presently was given although Schmidt indicated the software would debut soon. Google already has released a word processor Writerly; an Excel-like program called Google Spreadsheets; and an e-mail service called Gmail. Separately the company also offers Google Calendar Google Talk and Page Creator. Schmidt denied the comparison between Google Docs & Spreadsheets and Microsoft Office. 'It doesn't have all the functionality nor will it ever have all the functionality of products like Microsoft Office ' he reportedly said at the conference. On the same day that Google was presenting Presently the Google blog was announcing that the company had acquired Tonic Systems a company based in San Francisco and Melbourne Australia. Google: The ad dominator?


Is Google gearing up to dominate the entire advertising business? Consider that this month alone the search engine giant announced three major deals promising to extend its reach in advertising for radio television and the Web. On Apr. 16 Google (GOOG) announced a deal with Clear Channel (CCU) to serve 30-second audio ads across the company's 675 AM/FM radio stations.

The data is out there thanks to the Search Google Calendar a feature added to Google's Web-based calendar service last November. Google bills it as a cool way to discover interesting events but a few quick searches show that it can also be used to turn up sensitive corporate information inadvertently made public using Google Calendar.

GDAY WORLD #215 - Bitchin’ About Office 2007

Tonight in the Bitchcast, I’m joined by Jodie Miners and Tony Goodson. We bitched about a bunch of things, including (but not limited to):

  • Why HP don’t have Windows Vista drivers for the HP Photosmart 7150
  • How hard it is to move your iTunes library from your old PC to your new PC
  • Why Office 2007 is so goddamn slow, why they took out Clippy, and how much productivity LOSS the you-beaut ribbon is causing
  • Vista is nice and pretty and seems to work okay, but where did Microsoft’s 5 years of R&D go?
  • And why doesn’t Google Desktop seem to work properly in Vista?
  • “The Departed” is a good enough film but should Martin Scorsese really get a “Best Director” statue for making a carbon-copy film? (and then screwing up the last scene??)
  • Why wasn’t TalkShoe showing this podcast as being “live” while we were recording it? Why were people who came 15 - 30 minutes late not able to see the show or dial into it? What’s up with that?
  • Finally, we each suggest some great podcasts to listen to and blogs to read.
  • By the way, I apologise for my mic being up too loud at the beginning and blame it on the new PC. My set-up isn’t exactly right. Also - when I went to edit this show I discovered that 1Mb RAM isn’t enough! Not even with the Dual Core. The whole machine froze to halt.

    [March 07] SXSW: Christian Castle, and Honeycut

    Big shout outs tonight to my old buddy Shane Williamson for chucking some cash into the Shave thing. Thanks mate. Oh and thanks Jesus. Shane recently sold a copy of the infamous Microsoft Bob on ebay for the princely sum of $15.50. I’ve often thought about when the time will be right for me to auction off some of my Microsoft memorabilia so as to maximize the return on my investment. When they are finally acquired by Google perhaps?

    Another big shout out to my homies from Tassie - Bruce “The” Moyle and Q-Dog - from the Cool Shite crew. They were in Melbourne today for some event and we caught up for a quick bite afterwards. Always good to geek out with Bruce about movies and TV and as this was the first time I’ve met Q-Dog in person I was surprised to learn he isn’t gay after all. They have a real score on their show this week - an interview with Edgar Wright director of HOT FUZZ, the new Simon Pegg - Nick Frost comedy (the guys behind SHAUN OF THE DEAD). When I asked how they managed to get Edgar on the show they cockily informed me that HE contacted THEM. Bastards. Complete bastards.

    K-Fed: “Search Me!”

    Despite Scott’s slagging of Vista today, I like it - especially now that I’ve got 2GB RAM. Don’t tell anyone. I’d hate for Jeff Putt to hear about it. Okay so, as I said on the show the other night, it isn’t the major new paradigm that was promised over those long, long, Longhorn years. Remember quotes like these from BillG? Longhorn, the next version of Microsoft Corp.’s Windows desktop operating system, will be so different from its predecessors that users may not like it right away. (link) Longhorn makes it easy for your information to show up on any device. It makes it easy to navigate that information. (link) Say you keep lists. Anytime that you’ve mentioned a restaurant, it automatically goes onto this list of restaurants, and your system would automatically keep track of what are the hours there, how that menu has changed. (link) There is more R&D being spent on Longhorn than on the 747. (link) Now that we are moving to this Web services world"a loosely coupled, message-based breakthrough that computer scientists have dreamed of for decades"all of the things that let that be possible need to be in the US$50 operating system. And so here we have Indigo that will be in Windows and let you do transactions and queuing. (link) And let’s forget about WinFS…. But as an operating system, it’s pretty “neat” (I can imagine BillG calling it that… isn’t he just the child of the 50s??). Here’s my desktop at the moment: What do I like? 1. It’s prettier than XP. 2. When folders open and close they do this little.. shrinky… thing. It’s… neat. 3. Ummm… having the sidebar pre-installed is nice but I’d been running Yahoo Konfabulator for a few years on and off so it’s not an entirely new experience. It is, however, packaged. The widgets I’ve got installed are currently: iTunes controller News.com.au RSS feed Dual Core monitor Shortcuts to key docs and folders Melbourne’s weather Calendar 4. The little clock thing in the taskbar allows multiple timezones!! Now I can see what time it is in Scotland and Washington when I’m hiding from Ewan and Scott on Skype. I can wait until I know they are asleep before I stop lurking. 5. Most nearly everything I need is running. All except my printer. I had trouble with the scanner but Photoshop figured out how to make it work. 6. The “snip” tool from Windows XP Tablet PC Edition ships with it and that is VERY handy. 7. It’s pretty (did I already say that?) 8. The new Win-TAB is old technology (I can’t remember what it was called but I used to have an app which did that years ago) but great to have in the OS. 9. The way the little previews of the windows you have open pop up when you hover your mouse over the taskbar. 10. ummm. it’s pretty? The list of things I don’t like is shorter… 1. The integrated search is better but not, IMHO, as good as Google Desktop. Come on Microsoft. Catch up. 2. Hmmmm… no podcast support? 3. It doesn’t swallow? 4. Oh yeah. Google Desktop searches open in IE and not FF. I haven’t been able to figure out how to stop that. Anyone know the secret (no, not the stupid new agey documentary which says “whatever you conceive and believe you can achieve”, but just… the regular type secret)? 5. Oh yeah… I had to spend the first two days turning off the stupid security features. YES - I WANT TO RUN THIS FRAKKING APPLICATION! THAT’S WHY I CLICKED ON IT STUPID!! I don’t know. I can’t pick much fault with it so far I guess. But then again I’ve only had it four days. Give me some more time. Would I go out and pay real shells for it? No. The benefit over XP is really just cosmetic as far as I can tell. I really cannot for the life of me tell what’s truly new and innovative in Vista apart from the prettiness and I wouldn’t shell out $600 - $1000 for that. However, if you are getting a new PC and you have Vista as an option - and you are well aware that some of your software and/or peripherals may not work - then go ahead and move to Vista. Mum - that means you.

Sure Google gives you quick, accurate results and Yahoo is a similarly reliable force in the search engine world, but neither one will give you access to a “celebrity!”

    On Monday, five pairs of winners were randomly selected to win the grand prize " an invite to the party for the rapper-dancer’s 29th birthday that will take place Saturday at a Los Angeles nightclub. But other search engine denizens could luck into consolation prizes including autographed 8-by-10 glossies of K-Fed and copies of his album, “Playing With Fire.”

    Google My Map of Bass Point Dive Sites

    Dr. Gregory Berns was our guest for this Space Show program. Please note that this program was subject to excessive telephone line noise that could not be cleared up so the audio is not up to usual Space Show standards. We do apologize for this inconvenience. We began the interview with Dr. Berns explaining his scientific research to us regarding what motivates people, then extrapolating what he has discovered and applying it to the space industry, especially the entrepreneurial space community. We discussed the need for novelty and risk taking for the advancement of society and showed how space development and exploration serves this purpose. Dr. Berns also explained how risk defines our progress and is absolutely critical for our future. He also explained to us where this comes from in our brain and he provided us with the information to show that dopamine is the responsible substance/chemical in our brain for risk taking. He fielded several listener questions about the use of dopamine, even the supplemental use of it but as we learned, it does not work by popping pills from the health food store. We had a listener question that associated what Dr. Berns was saying to critical thinking and Kool Aid in the space community. Don't miss the response from Dr. Bern, especially since in his scientific research he actually used Kool Aid! Dr. Berns told us that this research and these cutting edge conclusions are not without their detractors because they have the potential to open up black box like areas of the human mind and many do not want to go there. He said it might be useful someday to predict what a person would do before he/she did it but doubted it would be useful in legal cases. He did discuss the legal ramifications of this work and said that its legal status was not determined at this time as it was too new but that both defense attorneys and prosecutors had attempted to use elements of this work in criminal cases but had not been permitted to do so by the court. The significance of Dr. Berns research for the developing space industry cannot be overlooked. I urge all of you to listen to this program, read Dr. Berns book, "Satisfaction: The Science of Finding True Fulfillment" which was published in 2005 by Henry Holt Publishers.     Twitter Fan Wiki - Twitter for all flavors…

    Twitter FanHere at the Global Geek we have adopted the world of Twitter as being a pretty cool place to be, it seems that everyone is getting into it lately and even the harshest of skeptics (I’m looking at you KW…) have taken to it readily (well I say readily, I mean kicking and screaming…).

    Now one of the coolest things about Twitter is that it has an open API that allows you to create applications for many different OS platforms. But one of the frustrations in finding a good Twitter client is that not all of them come with great features, so you have to try out a few before you’ll settle on one.

    Then the hunt begins as you type ‘Twitter Client + [name of platform here]’ into Google and you find out that no matter how you tackle it, there are a little over one million links to trawl through (most of them blog posts).

    This is where the Twitter Fan Wiki comes to the rescue, by not only telling you what is going on in the world of Twitter developments, but also by giving you a HUGE list of currently avaliable applications for you to try on your various platforms.

    Now as some of the current readers/listeners of the Podcast should know, Knightwise has been scouring the internet to find a decent client for his Palm Treo that will allow him to connect and update his Twitter account from where ever he happens to be.

    TreoTwitWell the day has come KW here it is, an actual Palm Treo Twitter client that looks good, and by all reports works great. The application is called TreoTwit which comes from miTreo.com and is currently up to version 0.85.

    So hopefully now Knightwise will be able to tell us what he is having for lunch, that he is stuck in crazy Belgian traffic or if he is wondering Will it Blend? any time of the day without the hassle of getting to a computer!
