I had this problem that my blog is looking fine on mozilla firefox but just run on internet explorer. After some research from googling it out from google, i read somewhere that IE6 has bug that makes wordpress theme alignment run and thus makes your sites look messy. YouTube in billion-dollar lawsuit
US entertainment giant Viacom sued Google and its subsidiary video sharing website YouTube yesterday for copyright infringement on "a massive scale " seeking more than US$one billion from the Silicon Valley company. The suit which was filed in New York on Tuesday morning alleges that YouTube has posted on its site more than 160 000 unauthorized clips of movies and TV shows from Viacom's cable networks.

Google Looses Again
Google recently failed to secure the “Gmail” name in a few European countries, this time they have lost again and once more it is Europe. Copyright is the issue this time, it has to do with the fact that Google reproduces news from other sources on it’s own pages.
I just had to talk about this because the country that launched the legal action was Belgium. For those that don’t know that is where co-host Paladin Knightwise is from. So what is the deal? The deal is that a group of 17 Belgian newspapers sued Google for reproduction of their content. Google counter claimed “fair use” and that they linked back to the original material. The court ruled in favour of the group due to the fact that the search engine cached links and content available for free that the newspapers would usually sell. They have demanded that Google remove all such links and material. Of course Google have appealed.
Copiepresse (the 17 strong group of papers) stated that the ruling could well set a precedent in other countries such as Norway, Austria and Italy having spoken to them. Google of course are worried and that is obvious by their response in which they just claimed that was false and that every country is different. Although at this time the ruling only affects Google.be according to Google representatives.
If Google do not comply with the court they are up for $32,000 per day. Legal representation for the newspapers say that the ruling also affects other versions, I am assuming that they mean other Google domains and not just .be. If this is the case then Google could be up for 4.3 million per day! They say that the ruling covers all Google domains and all content owned by the papers should be removed from every one.
Followed by more legal mumbo jumbo. But what stands out like proverbial dog’s you know what… is this huge clash of media. In one corner we have print. They don’t want their Newspapers being accessed for free. Then you have Google, the electronic scraper of the universe indexing all kinds of media. Print, blogs, video, newspapers, RSS feeds the lot. Most people would be stoked if their content was indexed by Google for their news service. The clash is a fight of the dying and birthing media. Newspapers will die one day. I have said before that if they do not evolve then in time they are dead.
People are changing, culture is changing media is changing. Some media is not changing with it. This is the news here. Not the fact that it is Google. Indeed other search engines are under the same scrutiny from similar services. The fact is that Newspapers want people to buy newspapers. Problem is that not everybody wants newspapers anymore. They are fighting a loosing battle.

"THE RIFLEMAN," STEVE McQUEEN, ET AL, ETC.

I've been thinking a lot about "The Rifleman" lately.
It all started just before Christmas, when I walked a slightly different route after work to get to the CTA Blue Line station at Daley Center -- and I passed by the still-under-constriction Museum of Broadcast Communications near the Marina City House of Blues. I'd visited the museum many years ago when it was housed in River City and enjoyed the exhibits a great deal. (I toured the museum with Chicago sportswriter and broadcaster George Castle, who's a font of pop-cultural information.) For a time, the MBC moved to the Chicago Cultural Center, but I never stopped in when it was there.
Anyway, as I walked past the museum, I began reflecting on TV shows that had an impact on me. Sure, the original "Star Trek" fueled my imagination, and "Adam-12" briefly stirred some interest in pursuing a career in law enforcement, but the one show that caused me to seriously reflect on the human condition while still in elementary school was "The Rifleman."
The two photos above are screengrabs from the first episode's scene in which we're introduced to Lucas McCain (Chuck Connors) and his son, Mark (Johnny Crawford), as they arrive in the New Mexico Territory of the 1880s. The show's haunting main theme plays in the background and, for a moment, shifts to a minor chord as Mark expresses concern and regrets in dialogue wonderfully written by Sam Peckinpah and masterfully handled by Connors and Crawford...
Lucas: Well, it's new and mighty fine country, son.
Mark turns and stares over his shoulder.
Lucas: There's no looking back -- we've come too far.
Mark: I wasn't really looking back. I was just remembering back.
Lucas: What do you say we start from here?
Mark: Fine.
Lucas: Let's go.
I like how the characters' backstories are only hinted at -- and then played out slowly in the episode and, indeed, in the series, as well. In a later scene the McCains check in at North Fork's hotel. In the lobby, they meet Vernon, a young gunslinger played by Dennis Hopper -- who'll be competing against Lucas later that day in a turkey shoot. Lucas heads upstairs to stow their bedrolls and tells Mark to go into the restaurant and "order for both of us." What's engaging about the following scene is how naturally Crawford and Hopper play their parts. It's acting done so well it doesn't seem to be acting. And the dialogue is finely crafted, as well. A lesser writer would have glopped it up with dialect, yet Peckinpah uses it sparingly.
Mark: Would you like to come and sit with me?
Vernon: Yeah, I guess I might as well.
Mark (to waitress): I'll have some of that beef stew.
Vernon: I'd like the same.
Mark: I guess you must be pretty fast with that gun.
Vernon: Well, I guess I'm just about as fast as anybody there is.
Mark: My pa, he doesn't use a pistol -- he uses a rifle, but he's pretty fast, too.
Vernon: No man with a rifle is as fast as a man with a six-gun.
Mark: My pa is. When we was living in the Nations, they used to call him "The Rifleman." He's the greatest shot in the world.
Vernon: Well, he may stand tall where you come from, kid, but he ain't shooting against no sodbusters. He's shooting against me.
Mark: You'll see. What's your name?
Vernon: My name's Vernon.
Mark: Mine's Mark McCain. Was that your pa in the lobby?
Vernon: No, he's my uncle.
Mark: My pa says I'm not old enough to carry a pistol right yet.
Vernon: I've been wearing one and shooting ever since I can remember. I must've had a gun since I was six years old.
Mark: You're lucky, Vernon.
Vernon: That's what my Uncle Wes says.
Mark: I can shoot my dad's rifle, but he won't let me carry a pistol.
Vernon: What about your ma?
Mark: She died -- a long time ago. What happened to yours?
Vernon: I never had one.
Mark: Don't it bother you, I mean, not having a ma or a pa?
Vernon: I reckon. Sometimes it bothers me considerable.
The scene is made all the effective by Herschel Burke Gilbert's gently poignant music. I especially like how Crawford delivers the line "He's the greatest shot in the world" with the genuine pride a child has for a loving parent. It reminds me of the way Billy Gray describes his mom's government job in "The Day the Earth Stood Still." He points out to Klaatu that the guy everybody calls a secretary isn't a secretary at all and that "My mom's a real secretary!"
I have to admit that while the hints of sadness and darkness Peckinpah injects into "The Rifleman" make the series -- especially its first season -- a classic for me, much of his later film work strikes me as needlessly cruel and violent. An exception is his 1972 "Junior Bonner," a star-laden (Steve McQueen, Robert Preston, Ida Lupino, Ben Johnson) picture that also explores father-and-relationships, but in a latter-day setting. A similar but more-Hollywooden treatment of this theme appears in Stuart Rosenberg's excellent "My Heros Have Always Been Cowboys," a 1991 production with Scott Glenn, Kate Capshaw and Ben Johnson.

This spectacular scene features a car crashing through the retaining wall in one of the tower's parking garages and then plowing into the Chicago River.
That scene provided the inspiration for a recent Allstate commercial.

I noticed the article while skimming the paper in a restaurant at lunch time but, of course, I can’t find it online. I’d love to know the actual numbers though. Okay, so this probably won’t be a challenge to Microsoft’s dominance of the VERY LARGE enterprises for a while, but that’s not the battleground. Small and Medium business is a much bigger market for these product than the big end of town. I remember from my MSFT days that the big revenue growth was expected to come out of SME. Now they have some serious competition.
New Prototype iPod: Or is it?
Not sure what to make if this discovery. I was reviewing a new service today called Wayki. It is based on the Google Maps API and allows users to put place marks on a world map. It allows for comments, pictures and replies in tabs when clicked. The thing that I liked was that you can also get a link from the place mark and link to it from your blog or where ever you like, some are included in this post. The pictures are displayed in a nice flash window. That’s the site in a nutshell.
But that is not what this post is about. I was looking about and decided to have a look at San Francisco. Not much there although I did find the host of Mythbusters had put an entry in (which was cool). I went down the coast to Los Angeles not much there either. Then I spotted something in San Diego. On hover it displays the title of the place mark… “New prototype iPods” so I clicked on it.
In the detail tab is written, “prototypes for apple”. Then I clicked the replies which had “12/13/06 7:25 PM Testing comments in IE7.”. That to me says that it is the developer testing the service. That alone casts doubt as to the rest of it, because it just could be bait to get people to use the service. Then I clicked the photo tab and I was amazed to find this:

Now I have no idea if this is real or not and I am not saying it is. But it could be. I am sceptical because it looks like a developer put it there as link bait. The other thing is that I thought it was a strange place geographically for the iPod to be developed. Anyone know where Apple bases their iPod development? In addition to this is the fact that the comment is dated from last year. It seems strange that it has been there that long and not noticed.
But the case for might be that this developer knows more than we give credit for. Bored iPod developer? It is also a very sneaky place to put a photo of a prototype iPod. Something that an individual would think was cool to get away with. It also seems like a lot of effort to go to for link bait. I would love to know that there was a picture sitting right under people’s noses of the new iPod and no one found it. It does look part of a bigger image as well. The quality of the image is not great so it is hard to tell if it is fake or not. It is clearer on a smaller image.
I have searched all the usual haunts for these images and have not found anything. There has not been any images posted anywhere that I can find that depicts these “prototypes”. I found that strange as well.
Me, I am going the way of saying that I think it might be link bait. But then I have no idea either. What do you think, cast your vote in the comments. Looks like a cool idea for the new iPod though, huge touch screen and what could be a “mini Mac” based on the tag line. But this is either cleaver link bait or the real deal.

Zoom Hack for Google Maps: Reports are Bogus
If you follow Tech news at all you will have heard, read or seem pictures of what are claimed to be mega-zoomed images on Google Maps. Further that these images are accessed by “hacking” a URL to display a higher “hidden” zoom level. Most feature a camel or what appears to be a village somewhere. Sorry to burst your bubble but no such hack exists or is necessary to see these images. It is a featured layer in Google Earth.
According to Google Sightseeing all this started after the Australia Day flyover and the not so recent African flyover project (2005). The results of both these flyovers are images with a higher zoom and translates to one or two steps in zoom levels that can be seen. These flyovers are done with light aircraft at low altitude. People don’t often look up to observe a passing satellite!
The high zoom levels are thanks to the National Geographic Layer that was added to Google Earth in September 2005. Google Earth blog covered this story in August 2006. In relation to this project there is a great collection of Placemarks that list a heap of animals from Africa and opening it in Google Earth will give you links to the photos, link is on the Google Earth Blog Post.
So there is no big conspiracy of hidden zoom levels or hacks to access them. Just turn on the “National Geographic Magazine Layer” in Google Earth under Featured Content. The long and the short is that the story is that there is no story.

Protecting Your Trademarks in Paid Search ; ; by Scott Fasser
Protecting your trademarks in the paid search channel is critical to maximizing the value of your brand. Here is a complete guide, with links, submitting trademark paperwork to the major engines plus strategies for dealing with affiliates and trademark bidding.

Why Should I Protect My Trademark? Your trademarked names or brand names are the most valuable keywords in your paid search arsenal. As you build your business, gain customers, send out press releases, buy media and acquire traffic - more and more people will enter your brand name or URL into search engines to find you. These terms almost always convert the best regardless of what your conversion metric is.
Because of this, your trademark can be under attack by competitors, uncontrolled affiliates and companies illegally using our products (more on this later). It is imperative that you understand your options, recognize the threats and have a course of action to protect your brand.
Search Engine Policies on Trademarks From the search engine company standpoint, refereeing the use of trademarks is a difficult and thankless task. Everyone who has a trademark thinks that they are special, lawyers get involved and search engine employees spend hours working through the issues protecting the rights of their advertising clients from illegitimate and illegal use of the trademark.
Additional considerations from the engines include whether the trademark violation is in the organic or sponsored area. If someone is improperly using your trademark and they show up in the organic area of the search engine results page (SERP) then you are out of luck from any recourse from the search engine companies. If it shows up in the sponsored (paid) area of the SERP then you have some recourse.
There are also specific procedures for whether your trademark is secured in the US, Canada, North America or Other. Most engines have a different process for Trademarks in different countries making both the problem and the solution more complex.
Ideally for the Search Engines, they would remain neutral in the use of trademarks and simply collect the money when people buy a trademark and use a trademark. However, in order to appease advertisers (aka trademark holders), the different engines have implemented different levels of trademark protection.
Google Trademark Policy: Google is the most lazes-faire of the engines with regards to trademarks. It used to be permissible to buy and use other people's trademarks in the sponsored link area. Today's rules help in terms of protecting the trademark holder, but don't go as far as the other major search engines. Here are some of the rules: -With the submission of the proper trademark paperwork (see link below), Google will block non-trademark owners from using the trademark in the copy of the advertisement. -A non-trademark owner can BUY the trademarked keyword, but the editorial filtering will restrict the use of the trademark in the copy - EXCEPT for the display URL. -I personally find this last bit concerning as testing has proven that the display URL is an important part of the copy. I haven't gotten a good answer on why the display URLis not included in the trademark protection. Yahoo! Search Trademark Policy Yahoo! has taken a stronger stand on trademark protection than Google which has also evolved over the years. You used to be able to buy competitor terms as long as you sent the traffic to a comparison page of products or services. That allowance has been eliminated if you are a competing site. Here is what they do allow: -If you are a retailer and are legitimately selling the trademarked good or service - you can buy the trademark keyword and use in your copy. -If you are a non-competitive site that is providing comparison content, you are allowed to buy and use the trademarked item.
In addition to trademark protection, Yahoo! offers an additional level of complaints based on Copyrights Infringement and alse/Misleading Claims. We've had some success going after sites that are illegally using free software to acquire credit card numbers and email addresses using these complaints as the foundation. MSN Trademark Protection Policy The MSN policy is very similar to the Yahoo! policy. No buying of someone's trademark unless it is one of the following situations:
-You are a retailer
-You have a legitimate information site
-You are clearly using the trademark in an ordinary dictionary manner (Kleenex for example)

What Do I Do About My Affiliates? The decision to allow or not allow affiliates to buy your trademarked keywords in paid search is a difficult one. Here are the pro's and con's to allowing this: Pro's for letting affiliates buy trademarked/branded keywords:
-Increases the number of slots taken up by your brand on the brand search thus freezing out competitors (particularly important in Google because competitors can still buy the keyword without using it in their copy)
-If structured properly, these high value keywords can be used as a carrot to expand the non-branded keyword programs your affiliates are using to drive traffic/sales to your site
-If, for some reason, your SEO efforts aren't effective for your keywords then you have more options for end users to click on a placement that leads to your site. Con's for letting affiliates buy trademarked/branded keywords:
-Affiliates care only about making money and will do, say just about anything to reduce costs and improve conversion - regardless of the reflection on your brand.
-Competitive affiliate bidding on branded keywords drives up the CPC of your branded terms increasing the cost per action of that keyword category.
-Branded keywords are "easy money" for affiliates and unless managed appropriately will only spend energy on these terms vs.expanding your overall program.There are three options for working with affiliates with regards to branded keywords:
-Do not pay for any sales, service or leads generated from your branded keyword list. The trend in the industry is to move more towards this position in order to reduce costs and have more control over the brand messaging.
-Give affiliates unfettered permission to use branded keywords in their paid search programs. This will result in the most sales and the happiest affiliates, but at higher costs and risks to the brand.
-Establish a set of messaging and bid-cap rules for affiliates with regard to using branded keywords including:
1.The maximum cost per click they are allowed to bid in the engines. This is a hard rule to monitor as none of the major engines give you exact data on what the affiliates max bid is. However, you can closely monitor your CPC for the category and ensure that you are in the #1 position. If your CPC for the #1 position goes over the max bid cap - you have reason to "talk" to the affiliates.
2.Stipulate a % of sales, leads, etc. that can come from branded keywords. Do this by using a unique linking URL for branded keywords by affiliate. This will let you see how much traffic/business is being generated by each affiliate.
3.Have a clear list of do's and don'ts with regards to the messaging and copy that can be used with the branded keywords. Make sure to give the affiliates lots of examples of what they CAN say in conjunction with very strict guidelines of loaded keywords, numbers,amounts, discounts, etc. that are off limits.
4.Set aside time on a regular basis to monitor the affiliates. Engage your top affiliates to help monitor the rules as well so that you have more eyes keeping the playing field level.
5.Have strict two strikes rules on your affiliates. You can give an affiliate (especially a new one) one strike with regards to these rules. Second strike should be an immediate restriction of those keywords and/or exclusion from the program. Do not waffle on this or your will get into issues of "fairness" with the broader affiliate group. What to Do Next 1.Get the trademark documents from your (or your clients) legal department for as many countries as you have trademark rights for. These should be in a PDF form that you can submit with the paperwork to the engines.
2.Decide what you are going to do with affiliates. If you submit trademark paperwork to the engines and do not give them an exclusion list for the affiliates - you will shut out your affiliates from the branded keywords inadvertently.
3.Assemble a list of "approved" affiliates/vendors that can use your trademarks. Get URLs, official email addresses and account numbers for each engine for each approved affiliate/vendor to use your trademarks.
4.Alert your account managers for the various engines with regards to what you are doing so they can help. Many account managers can help smooth the flow of decision making to get these rules in place more quickly.

6.Persevere. This is not an easy or smooth process for anyone. Lots of questions will arise, lots of people can get involved and there needs to be lots of communication to all parties to be effective.
7.Monitor, monitor, monitor. Just putting rules out there without a consistent vigilance to monitor is wasted energy. You have to set aside time and stay on top of your terms and who is saying what with regards to them in paid search (and online for that matter - a different article).
